DENVER—State officials are backing off earlier statements that a Colorado state senator is being investigated for allegedly misleading consumers with advertising flyers that look like official tax documents.

Last week, Division of Real Estate Director Erin Toll said Republican state Sen. Ted Harvey was under investigation and that her department's investigators believed the flyer violated the law.

Harvey is a broker for American Home Funding, which circulated the flyer.

Late Friday, division spokesman Chris Lines said Harvey "is not the subject of any investigation by the division." He refused further comment.

Harvey said Monday he's glad the division backed off its earlier statement.

Toll didn't immediately return calls seeking comment.
